Viva Mexico Shigella Outbreak Litigation
Over 250 individuals became ill with Shigella bacterial infections, and one person died, after eating at the Viva Mexico restaurant in Redwood City, CA in October, 2000. An outbreak investigation conducted by the California Department of Health Services (“CDOH”) and the San Mateo County Environmental Health Department (“SMCEHD”) revealed that salsa served at the restaurant was the vehicle of transmission for the Shigella bacteria.
The CDOH and SMCEHD investigation further revealed multiple violations of the California Uniform Retail Food Facility law. After the investigation, Viva Mexico closed.
Marler Clark represented several victims of the outbreak in litigation against Viva Mexico. All clients’ cases were settled for confidential sums.
